CTA has been informed that Environment Climate Change Canada (ECCC) has further extended the consultation phase of their Heavy-duty Vehicle and Engine Greenhouse Gas Emission Regulations (Trailer Standards) until at least May 18, 2021.
The second Interim Order was made by the Minister on May 18, 2020 and approved by the Governor General in Council on May 27, 2020. It is expected that the second Interim Order will be published in the Canada Gazette, Part I, on June 6, 2020, and will then be available, along with the explanatory note, on the Canada Gazette website at: http://www.gazette.gc.ca/accueil-home-eng.html.
The purpose of the second Interim Order, made pursuant to subsection 163(1) of the Canadian Environmental Protection Act, 1999 (CEPA), is to further delay the implementation of the greenhouse gas (GHG) emission standards for trailers in Canada by one year after the order is made, that is until May 18, 2021. This second Interim Order will provide the Department time to conduct further analysis on the economic impacts of implementing trailer standards in Canada to inform a future decision on whether Canada should maintain or amend its trailer standards. This will also allow time to consult with stakeholders on the path forward for Canada.
The second Interim Order was made before the first Interim Order expires on May 27, 2020, to avoid any regulatory gap for the industry. Given that the second Interim Order was made by the Minister, the Department will be putting a hold on the processing of applications for authorization to use the National Emissions Mark and Canada-Unique submissions for trailers until further notice. The second Interim Order does not affect any provisions related to the heavy-duty vehicle and engine standards of the Regulations.
